When an order can change
A real change since the order was made
The court can usually change an order when circumstances have changed in a meaningful way since it was made. Common examples:
Job loss or an income change
A lower or higher income can change the support that should be paid.
Children's needs have changed
For example, a child's age, schooling, health or living arrangements.
Relocation
A parent wants to move with a child, or has moved, and the schedule no longer works.
Parenting time not being used
A parent is not exercising the parenting time the order gives them.
What happens
How a motion to change works in Brampton and Milton
The usual steps
- A motion to change (Form 15) is filed with a change information form and, if support is involved, financial disclosure.
- In Brampton and Milton, the first step is usually a conference with a Dispute Resolution Officer (DRO), a senior family lawyer who helps the parties narrow the issues.
- If the issues do not settle, the case moves to a settlement conference or a motion.
- The existing order still applies until the court changes it.
Support arrears: act early
If your income has dropped, start the change as soon as you can. Courts ask why a change was not sought sooner, and arrears that built up while nothing was done are hard to reduce.
Until the order is changed, the Family Responsibility Office keeps enforcing it as written.

Can support go down if I lost my job?
Possibly. A real drop in income can be a change that justifies a lower amount. The court looks at whether the change is genuine and lasting, and at your efforts to find work. Start the change promptly.
Can arrears be reduced?
Sometimes, for example where income fell and the payor genuinely could not pay. The longer the delay before asking, the harder it usually is.
Can I move with my child?
Usually you must give the other parent written notice at least 60 days before a relocation, and the move may need their agreement or a court order. Speak to a lawyer before you make plans final.
Do I have to keep following the old order?
Yes. The existing order applies until the court changes it, even while a motion to change is under way.
