Family Law

Divorce Lawyer in Mississauga

Our main offices are in Mississauga, on Cawthra Road and at Village Centre Place. Family law matters for Mississauga residents are heard in Brampton, and we appear there regularly.

We act for Mississauga clients through every stage of a divorce from our offices on Cawthra Road and at Village Centre Place, from the first conversation about separating to the divorce order itself.

Divorcing in Peel: choosing the right court

Family matters for Mississauga residents are heard at the A. Grenville & William Davis Courthouse at 7755 Hurontario Street in Brampton, which houses both the Ontario Court of Justice and the Superior Court of Justice. Only the Superior Court can grant a divorce or divide property. If a parenting or support case has already started in the Ontario Court of Justice, the divorce and any property claim still need their own application in the Superior Court, so the choice of court at the outset matters.

If you married outside Canada

An Ontario court can grant a divorce if either spouse has been ordinarily resident in Ontario for at least one year before the application, even if the marriage took place abroad and the other spouse lives overseas. You will need the marriage certificate, with a certified translation if it is not in English or French, and serving a spouse who lives in another country takes longer to arrange. A religious divorce on its own does not end a civil marriage in Canada; a court order is still required.

FAQ

Mississauga family law questions

Ask us directly
Where are Mississauga family law matters heard?

At the Ontario Court of Justice and Superior Court of Justice at 7755 Hurontario Street in Brampton, which serves the Region of Peel. We appear there regularly and can advise on what to expect from the local process.

Do I have to come to your office?

No. We offer consultations by phone and video, and documents can be exchanged and signed electronically. Where an in-person meeting helps, our two Mississauga offices are close by, on Cawthra Road and at Village Centre Place.

How soon can I be seen?

Call (416) 572-7483 or use the contact form. If your matter is urgent, a child being withheld, support cut off, or a safety concern, say so and we will prioritise it.

How long does it take to get a divorce in Mississauga?

An uncontested divorce typically takes 3 to 6 months, while contested divorces can take longer depending on the complexity of the issues and court availability.

Do I need to be separated before filing for divorce?

Yes. In most cases, you must be separated for at least one year before finalizing a divorce in Canada, unless there is proof of cruelty or adultery.

What is the difference between separation and divorce?

A separation means you and your spouse live apart, but are still legally married. A divorce legally ends your marriage and allows you to remarry.

How much does a divorce lawyer cost in Mississauga?

Costs vary based on the complexity of your case. Uncontested divorces cost less, while contested divorces involving disputes may require additional time and resources. We offer transparent pricing and consultations.

Who gets custody of the children?

Ontario courts do not favour one parent over another. Decisions are made based on the best interests of the child, including stability, safety, parenting ability, and the child’s needs.

Will I have to go to court for a divorce?

Not always. Many divorces are resolved through negotiation or mediation. Court is usually required only when major issues remain unresolved.

What happens to our home after divorce?

The matrimonial home is considered a shared asset, regardless of who owns it. Both spouses typically have equal rights to its value unless exclusions apply.

Can I get divorced if my spouse does not agree?

Yes. A spouse cannot stop the divorce process. They may delay it by contesting certain issues, but they cannot prevent the legal dissolution of the marriage.
