Marriages, property, and family abroad

A marriage validly performed in another country is generally recognized in Ontario. Property outside Canada counts too: a house, land, or a bank account in another country is included in each spouse’s net family property in the same way as property in Mississauga. We help clients gather valuations and documents from abroad, and we take care where a separation or agreement also needs to be respected in another country.

Where Mississauga family matters are heard

Mississauga is part of the Region of Peel, and family matters are heard at the A. Grenville & William Davis Courthouse at 7755 Hurontario Street in Brampton. Two courts sit there. The Ontario Court of Justice can decide parenting and support claims, but it cannot grant a divorce or divide property; those claims belong in the Superior Court of Justice. Starting in the right court avoids having to start again.

Getting started

Bring what you have to a first meeting: the date of separation, recent tax returns and notices of assessment, pay statements, a list of assets and debts, and any existing agreement or court document. If any property or accounts are held outside Canada, bring whatever records you have for those as well. If you do not have these to hand, come anyway.
